Terms and conditions for participation in a community event as a fundraiser for British Heart Foundation

Participation in the Event as a fundraiser (a “Participant”) for the BHF (“BHF” or the “Event Organiser”) is subject to these terms and conditions.

1. Registration and fundraising for BHF

a. All Participants must be registered to take part in the Event.

b. All Participants must raise funds for BHF. BHF will provide sponsor forms in the Welcome Pack and an online fundraising page can be set up through justgiving.com/bhf

2. Entry Forms and Fees

a. Each Participant must complete and sign a BHF Entry Form and pay a non-refundable and non-transferable registration fee (“Registration Fee”) to BHF to enter the Event as a Participant.

3. Age of participants

a. All Participants must be aged 18 or over by the date of the Event unless the Event Organiser’s state a different minimum age limit. Parental consent will be required for all Participants under 18, where applicable.

4. Conditions of entry imposed by the event organiser

a. By registering, each Participant acknowledges that the Event is an endurance event and warrants that they are sufficiently fit and able to enter the Event and that they have undertaken suitable training and preparation for their participation in the Event.

5. Safety

a. All Participants take part in the Event at their own risk.

b. All Participants must follow instructions from officials and marshals before, during and immediately after the Event.

c. All Participants acknowledge and agree that the Event may take place in public spaces and the Event Organiser cannot be held liable for any damage caused outside of its direct control.

6. Liability and insurance

a. All Participants enter this Event entirely at their own risk. BHF, its agents, or representatives shall not be liable for any injury or loss that might occur as a result of their participation other than as a direct result of the negligence of BHF or to the extent that any liability cannot be lawfully restricted or excluded by BHF under applicable law.

b. Participants’ friends and family members who attend the Event as supporters or spectators do so entirely at their own risk. BHF, its agents or representatives shall not be liable for any injury or loss that might occur as a result of their attendance other than as a result of the negligence of BHF or to the extent that any liability cannot be lawfully restricted or excluded by BHF under applicable law.

c. BHF shall not be liable for any loss or damage sustained by a Participant as a result of: the cancellation of the Event for any reason; any changes made to the Event for safety or any other reasons; or any circumstances beyond the control of BHF.

d. All Participants shall be responsible for arranging their own suitable and adequate insurance protection to cover their participation in the Event, including, without limitation, cover for: material loss or damage to their personal property; any loss or damage they may cause to a third party; sickness; or negligence of any party. Any accident or injury caused by a Participant’s actions shall be the responsibility of that Participant.

e. Each Participant is responsible for his/her actions whilst attending or participating in the Event.

7. Withdrawal and refunds

a. No Registration Fee will be refunded in the event that a Participant elects not to participate in the Event for any reason.

b. Registrations to participate in the Event are non-transferable to another year. Participation in the Event is personal to each Participant and Participants are strictly prohibited from swapping, selling or transferring their place in the Event or allowing any other person to participate in their place.

c. Participants must send written confirmation of their withdrawal via letter or email.

d. The Event Organiser or its agents or representatives reserve the right to refuse entry to the Event or ask a Participant to cease participation if a Participant:

i. Fails to follow instructions given by Event officials;

ii. Attempts to participate in the Event in a manner that the Event Organiser, its agents or representatives acting reasonably believes:

1. may cause injury to the Participant;

2. may cause injury to another Participant;

3. may damage or harm the environment;

4. is likely to cause offence; or

5. otherwise cause a risk or potential risk to health and safety including any failure, in whole or in part, to comply with the restrictions in clause 6 above (Safety).

iii. If in the Event Organiser’s or its agents or representatives opinion a Participant is unfit to participate in the Event due to:

1. the consumption of alcohol;

2. the use of drugs;

3. an injury or illness; or

4. failure to arrive at the start check in at the specified time.

8. Cancellation and changes to the Event

a. The Event Organiser may cancel the Event if circumstances beyond its control arise. In the event of cancellation of the Event the Event Organiser will have no responsibility for any costs incurred as a result of cancellation including any travel or accommodation costs, including a Participant’s travel to the Event location. Entry fees are non-refundable and any refund offered will be at the absolute discretion of BHF.

b. Any changes to the Event will be communicated to you at the Event or sooner if practicable.

c. If the Event is cancelled for any reason, BHF will return any sponsorship money paid, upon request of the payee. BHF is unable to refund the non-refundable Registration Fee.

9. Photos and Publicity

a. Photographs and films will be taken throughout the Event by BHF or its agents or representatives. All Participants consent to their names, video footage and photographs taken of them during the Event to be used to publicise BHF and its trading companies for commercial and fundraising purposes including, but not limited to marketing material, television broadcasts, social media, advertising, publications, and other documents or mediums that may be made available to the public. No payment will be made to any Participant for the use of any photographs or films in which they feature.

b. Photographs of children will not be used in this manner without express written consent; unless the images are incidental, for example, children’s images at the start line within the crowd.

10. Health and Fitness

a. Running and cycling events such as these can be strenuous, so Participants must be in good health to participate in the Event.

b. BHF understands that heart patients are keen to support BHF, but Participants who have any doubt about their health or have a medical condition that could be affected by exercise, particularly a heart condition, must obtain their doctor’s approval before participating.

c. All Participants must be sufficiently fit to undertake the Event and it is each Participant’s responsibility to assess their fitness and ensure that they participate only if they are sufficiently fit and prepared.

d. All Participants in Events involving cycling must wear a cycle helmet during the Event.

11. Data Protection

a. Each Participant agrees that information provided to BHF in connection with the Event may be used by BHF in accordance with prevailing data protection legislation.

b. BHF will use the information provided by Participants to register applicants and process registration applications, contact Participants to give details of the Event and other similar events, and, in the case of photos or video footage, as marketing material for BHF in accordance with their stated preferences.

c. We reserve the right to pass all information provided by a Participant to any first aid organization or medical provider attending and assisting at the Event (“Medical Provider”), for example, St John Ambulance, for safety purposes. This is to enable the Medical Provider to:

i. Administer first aid in the event that a Participant suffers illness or injury during the Event; and

ii. To contact the friends or relatives of a Participant, where necessary.

d. You agree that any Medical Provider may provide BHF with:

i. The names of any Participant that they treat during the Event together with details of the circumstances surrounding that treatment; and

ii. The name of any Participant who notifies the Medical Provider that they are withdrawing from an Event due to ill health or otherwise.

12. Fundraising

a. Participants agree that all funds raised as a result of their participation in the Event shall be raised using legal methods and in compliance with the advice given by the Event Organiser.

b. Please note that we are unable to accept any sponsorship money on the day of the Event.

13. Payment of Funds Raised

a. Participants agree that all funds raised through the sponsorship of their participation in the Event shall be paid in full to BHF within six weeks of the Event date.

b. All funds raised for BHF shall be paid to BHF.

14. Acceptance of these Terms and Conditions

a. By registering to participate in the Event, each Participant agrees to be bound by these terms and conditions.

15. General

a. If any term in these terms and conditions is found to be unenforceable, it shall be deemed modified to the minimum extent necessary to make it enforceable. If such modification is not possible, the relevant provision or part provision shall be deemed deleted and shall not affect the validity and enforceability of the rest of the terms and conditions.

b. BHF reserves the right to change these terms and conditions at any time provided 14 working days written notice is given in advance.
